By utilizing the services of NestWell Nanny Agency, you agree to the following Terms & Conditions.
1. Services Provided
NestWell Nanny Agency offers:
Nanny matching and placement
Background check coordination
Contract setup guidance
Nanny share facilitation
Related childcare consulting services
We act strictly as a facilitator between families and candidates.
2. Pricing & Payment
Pricing may change with prior notice.
Accepted payment methods: PayPal (required), Venmo, and in some cases, Cash App.
All payments for placement services must be made either:
In full at the time of enrollment, or
Through an approved installment plan (terms discussed prior to enrollment).
Application and onboarding fees are non-refundable.
3. Nanny Matching & Screening Disclaimer
While we strive to provide high-quality matches, NestWell Nanny Agency does not guarantee employment outcomes.
Families are solely responsible for:
Conducting interviews
Making hiring decisions
Negotiating compensation
Executing employment contracts
We are not responsible for employment outcomes or agreements made between families and nannies.
4. Background & Reference Checks
Written consent is required before conducting any background check.
Background checks are for informational purposes only. Personal information is not retained beyond the scope of the request.
Fees are non-refundable, and once a background check link is issued or processing begins, no refunds will be provided.
Links expire after 7 days; a new check must be purchased if expired.
We are not responsible for delays or errors caused by Checkr, courts, government agencies, or candidate noncompliance.
5. Nanny Share Agreements
We facilitate connections and provide guidance but do not mediate disputes.
Families are responsible for cost-sharing arrangements and finalizing written agreements.
6. Liability & Indemnification
NestWell Nanny Agency is not liable for actions, disputes, damages, or claims arising after placement.
By using our services, you agree to indemnify and hold harmless NestWell Nanny Agency from any claims related to your employment of a nanny.
7. Confidentiality & Privacy
All information about families and nannies is confidential.
Personal data is never shared without explicit consent.
Families must respect the privacy and confidentiality of nannies.
8. Cancellation & Refund Policy
Application / Onboarding Fees: Non-refundable
Background Check Fees: Non-refundable
Ongoing Services:
Within 24 Hours: Full refund if cancellation requested.
Within 7 Days: 70% refund if cancellation requested.
After 14 Days: Refunds generally not issued; partial refunds may be reviewed case-by-case.
Free Replacement: One complimentary replacement search may be provided depending on package and circumstances.
Late Payment & Service Suspension Policy:
Advance Notification: Payment reminder 3 days prior.
24-Hour Grace Period: One-day grace period.
Day 2: $25 late fee applied.
Day 5: Services temporarily placed on hold.
2 Weeks: Temporary ban from all resources and support.
30 Days: Full account ban until balances cleared; additional $35 late fee; agency may notify third parties or credit agencies.
9. Governing Law
These Terms are governed by the laws of New York State, United States.
Disputes should first be addressed through mediation before pursuing legal action.
10. No Guarantee of Match
While we strive to provide high-quality matches, no specific match is guaranteed. Results depend on market availability and candidate interest. Families remain responsible for interviews, hiring decisions, compensation negotiations, and employment contracts.
11. Agreement to Terms
By using NestWell Nanny Agency’s services, you confirm that you have read, understood, and agreed to these Terms & Conditions.

These Terms & Conditions apply to all nannies using NestWell Nanny Agency. By using our services, you agree to the following:
1. Our Services
Free Placement Support
We connect nannies with families in NYC at no cost for standard placement support.
Optional Add-Ons (Fee-Based Services)
The following services are optional and available for an additional fee:
Background Checks
CPR & First-Aid Training
Resume Setup & Updates
Specialty Certifications
Contract Review & Guidance
Workers’ Rights Coaching
Parent Recommendation Assistance
Customized Job Matching
2. Background Check Requirement & Options
Every nanny must have a valid background check on file within 15 days of completing the application.
Accepted Options
Submit your own background check (completed within the last 12 months)
Have the hiring family conduct the background check
Purchase a background check through NestWell (processing fee applies)
Use any reputable third-party background check provider
Policy & Fees
Validity: Up to 12 months; some families may require checks within the last 6 months or 30 days
Cost Responsibility: Covered by family or candidate, depending on the position
Agency Options:
Basic: $27
Standard: $57
Comprehensive: $87
Completed background checks are required before any placement can be finalized
Fees are non-refundable
3. Fees & Payment
Optional add-ons are individually priced; full payment is due at purchase unless a payment plan is approved
Two or more add-ons: deposit & weekly plan may be requested with agency approval
Accepted payment methods: PayPal, Venmo, Cash App
4. Payment Information & Refunds
Digital invoice and receipt emailed for every transaction
Refund Policy:
100% refund if canceled within 24 hours of purchase
After 24 hours, refunds generally not issued; partial refunds may be considered case-by-case
Background checks are strictly non-refundable
5. Add-On Service Payment Policy
Notification 3 days prior; 24-hour grace period applies
Payment not received within 24 hours: $15 late fee
Payment not received by day 5: temporary hold on add-on services/profile for 72 hours; no additional add-ons may be purchased
2 weeks of nonpayment: temporary ban from online resources; profile on hold
30 days of nonpayment: banned until all outstanding payments cleared; additional $15 late fee
Unresolved accounts may be moved down the list of eligible nannies
Families may be contacted regarding continued placement
6. Confidentiality & Privacy
All family and nanny information is strictly confidential
Nannies must maintain strict confidentiality about family information
7. Accuracy of Information & Disqualification
NestWell relies on accurate resumes, references, certifications, and background checks
False, misleading, or omitted information may result in:
Immediate removal from the roster
Permanent ban from future placements
8. No Guarantee of Job Placement
Job placement is not guaranteed
9. Service Modifications
NestWell may modify, suspend, or discontinue any service or add-on at any time, with or without notice
If a paid add-on is discontinued before completion, prorated refunds may be requested
Payment Notes:
All payments via PayPal invoice
Venmo and Cash App accepted in some cases
Pricing may change with prior notice
All information provided is true and accurate.
You understand that providing false or misleading information will result in an automatic and permanent ban from NestWell Nanny Agency
